First, here are mistakes you should avoid when filing insurance claims :
Failure to accurately calculate losses. It's hard to believe, but many
people can't accurately determine their losses-whether by damage or
theft. Reason: They fail to maintain effective accounting and
record-retender procedures to document the losses. It's not uncommon to
hear of a situation where a theft loss amounted to $250,000 but the
claimant could only substantiate $100,000 of the loss.

Overstating the loss. This is a subtle problem. If a claimant purposely
overstates the loss to the point where the insurance company could
question his integrity, the latter will take a hard line. Generally, if
the claimant takes a fair position, the insurer will still bargain over
the loss claim but will be more reasonable.
Underestimating the loss. This sounds like a contradiction of the above,
but it's not. Immediately after losses are claimed, adjuster will ask
claimant for an estimate of the damage, not an accurate, justified
number. The insurer requires such a rough estimate, but be wary of
providing a number before taking time to get a reliable estimate. If the
adjuster reports a number that's too low and then must go back later to
the insurer and restate it much higher, his credibility and yours are
hurt. He looks foolish. Those hurt feelings can make future loss
negotiations tricky. So tell the adjuster about any problems in coming
up with a number.
On a
related matter, how much fire insurance do you need?
Most standard homeowners policies will pay the full value of the policy
only if that value is 80 % or more of the replacement value of the
house. If coverage is below 80 %, the maximum payment is limited to the
replacement value minus a depreciation charge (usually quite large)
figured according to the age of the house. The burden of keeping
coverage to at least 80% of replacement value rests with homeowner.
Advice: Increase coverage annually, to keep up with inflation.
Keep
Insurance Ahead Of Inflation
Keeping insurance coverage ahead of the inflation rate can be difficult.
What to do:
Keep homeowner's coverage at a minimum of 80% of current replacement
cost.
Take replacement cost policies for furnishing and other possessions.
These reimburse for the cost of the replacement at prices in effect at
the time of the loss.
Use a health-care cost index to figure how much more coverage you'll
need, rather than an inflation index. Over the past five years, the rise
in medical services has outstripped inflation. (Watch the newspaper for
the monthly Consumer Price Index report, which breaks down medical
costs.)
Jewelry, furs, and silver pieces should be included, piece by piece, on
your homeowner's policy. Increase deductibles on cars and homeowner's
comprehensive coverage. It will cost more if something is stolen or
destroyed by fire, but premiums can significantly lower.

Many people who own cooperative or condominium units may be taking a
risk they are not aware of. If there is a serious disaster from a fire,
flood, or other catastrophe, collective insurance may not be enough to
restore the dwelling. In that case, each owner would be assessed to pay
for expenses above the liability coverage.
Solution: for a small fee, tack coverage for uninsured damages onto your
regular policy, which normally covers the contents of your unit and
improvements. Suggested coverage: $25,000. The cost is negligible.
When buying a unit, ask the project's board of directors how much
liability insurance they carry in case of an accident on the common
ground. Most projects do carry adequate amounts of this type of
coverage.

For Injuries To Uninvited Guests
Courts in many states are more likely than ever to hold an owner
responsible for injuries to a visitor. That's so even though the person
was on the property without an invitation. The old distinction between
an invitee (someone asked onto the property) and licensee (someone on
the property without an invitation) is breaking down. Traditionally,
invitees would be awarded higher settlements for damages.
Now courts in about one-third of the states ignore the distinction
between an invitee and licensee and hold the property owner responsible
for keeping the property safe for both invitees and the self-invited.
Now: Salespeople, whether they contacted
the customer before their visit or not, are generally treated (by courts
recognizing the distinction) as invitees.
Law When Trespassing Children Are Injured
A property owner or contractor may be liable for damages if a child is
hurt on the property (or by unguarded machinery) even though the child
trespassed. A "No Trespassing" sign isn't enough.
Example: A swimming pool should be surrounded by an adequate fence and a
locked gate.
General rule: The attractive nuisance doctrine in the law makes the
property owner responsible for trespassing children who are too young to
understand the dangers.
Special problem: Protection while construction work is being done or
when machinery is left unguarded in a residential area (or near heavily
traveled streets).
